1. About PakSoft and Our Services

PakSoft provides software development and digital agency services, including but not limited to: web and mobile application development, e-commerce solutions, UI/UX design, custom software, SEO and digital marketing, and related consulting services.

The descriptions of services on our website are for general information. The exact scope, deliverables, timeline and price of any engagement are defined in the individual quote, proposal or contract agreed with each client.

2. Quotes, Proposals and Contracts

Requests submitted through our website (e.g. the contact or start-project forms) are inquiries and do not create a binding agreement.

We will respond with a quote or proposal describing scope, deliverables, schedule and fees. A binding engagement arises only when both parties confirm the proposal in writing (including by email) or sign a service agreement.

Unless otherwise agreed, quotes are valid for 30 days. Changes to scope after acceptance may require a revised quote and timeline.

3. Payments

Payment terms (currency, installments, milestones, due dates) are specified in each quote or contract. Unless otherwise agreed, invoices are payable within the period stated on the invoice.

We may suspend work on a project if agreed payments are overdue, after giving reasonable notice.

4. Client Responsibilities

To deliver projects on time, we rely on your cooperation. You agree to provide accurate information, timely feedback, and any content, credentials or access reasonably required for the project.

You are responsible for ensuring that materials you provide to us (texts, images, logos, data) do not infringe third-party rights and comply with applicable law.

5. Intellectual Property

Website content: all content on https://www.paksofts.com — including text, graphics, logos, designs and code — is owned by PakSoft or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce or distribute it without our prior written permission.

Project deliverables: unless otherwise agreed in the project contract, intellectual property rights in bespoke deliverables transfer to the client upon full payment. PakSoft retains the right to use general know-how, reusable components and open-source elements, and — unless the client objects — to reference the project in its portfolio.

Third-party and open-source components remain subject to their own licenses.

6. Acceptable Use of the Website

When using our website you agree not to:

attempt to gain unauthorized access to the website, its servers or connected systems;

interfere with the website’s operation, including through malware, scraping at abusive rates, or denial-of-service activity;

use the website for unlawful, fraudulent or misleading purposes;

submit content through our forms that is illegal, defamatory or infringes the rights of others.

We may restrict or block access for users who violate these rules.

7. Third-Party Links and Services

Our website may contain links to third-party websites and services (for example social media platforms). We are not responsible for the content, privacy practices or availability of third-party sites. Accessing them is at your own risk and subject to their own terms.

To the maximum extent permitted by applicable law, PakSoft shall not be liable for indirect, incidental or consequential damages (including loss of profits, data or business) arising from the use of the website. For contracted services, our total liability is limited to the fees paid for the specific service giving rise to the claim, unless mandatory law provides otherwise or in cases of intent or gross negligence.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer protection rules.

9. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with the website or our services are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Yozgat, Turkey shall have jurisdiction, without prejudice to any mandatory jurisdiction rules that apply to consumers.
